Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website newcohome.com, project.newcohome.com, and any related subdomains, applications, portals, and services (collectively, the "Services") provided by NewCo Home, LLC, a Utah limited liability company ("NewCo Home," "we," "us," or "our"). By accessing, browsing, submitting a form, calling, texting, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

NewCo Home is a Utah-licensed residential builder and general contractor (License #8212320-5501) offering custom homes, remodels, additions, and exterior improvements. The Services include marketing content, lead intake, scheduling, estimates, proposals, contracts, project management, and related communications. Nothing on this website constitutes a binding offer to perform work; a written, signed contract is required before any construction services are performed.

When you submit a form, request a consult, chat with us, or otherwise provide your phone number or email, you expressly consent to receive communications from NewCo Home and its authorized service providers, vendors, subcontractors, and marketing partners (collectively, "Authorized Partners") regarding your inquiry, project, scheduling, estimates, proposals, invoices, service updates, and related offers. Communications may include phone calls, voicemails, SMS/MMS text messages (including A2P 10DLC application-to-person messaging), emails, push notifications, and calendar invites.

You agree these communications may be sent using an automatic telephone dialing system (ATDS), an artificial or prerecorded voice, or an automated SMS platform. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Supported carriers include AT&T, Verizon, T-Mobile, US Cellular, and other major US carriers; carriers are not liable for delayed or undelivered messages.

Opt-out: Reply STOP to any text message to unsubscribe from SMS. Reply HELP for help, or email Hello@newcohome.com. You may unsubscribe from marketing email at any time using the link in any email or via our unsubscribe page. Transactional messages tied to an active project, appointment, or contract may continue as required to deliver the Services.

You acknowledge and agree that NewCo Home may share your contact information (name, phone, email, project address, and project scope) with Authorized Partners — including but not limited to subcontractors, suppliers, lenders/financing partners, designers, architects, inspectors, insurance providers, scheduling vendors, communications platforms (SMS/voice/email providers), CRM and analytics providers, and payment processors — for the purpose of fulfilling your request, quoting your project, performing the work, and operating the Services. These Authorized Partners may contact you directly by phone, text, or email regarding your project, and your consent in Section 3 extends to those contacts.

All estimates and proposals are valid for the period stated on the document and are subject to site verification, permitting, material availability, and changes in scope. Final pricing is set by a signed contract. Allowances, change orders, and milestone payments are governed by the executed contract for your project.

You agree not to misuse the Services, including by: (a) attempting unauthorized access; (b) interfering with site operation; (c) uploading malicious code; (d) submitting false or impersonating information; (e) scraping or harvesting data; or (f) using the Services to violate any law, including the TCPA, CAN-SPAM, or applicable consumer protection statutes.

All content on the Services — including text, photos, renderings, plans, logos, and software — is owned by or licensed to NewCo Home and is protected by US and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the website will be uninterrupted, error-free, or secure. Construction warranties, if any, are set forth exclusively in the signed contract for your project.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWCO HOME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AUTHORIZED PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE SERVICES.

You agree to indemnify and hold NewCo Home harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Services.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction and venue there.

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Services constitutes acceptance of the revised Terms.
